Terms of Service
The rules that govern your use of TAG Market, operated by Tag Market West Africa Limited. Please read them carefully before placing an order.
1. Acceptance of Terms
By accessing or using TAG Market, including our website, mobile experience, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use our Services.
These terms apply to all visitors, users, customers, and anyone who accesses our platform. We may update these terms from time to time. Continued use of the Services after changes take effect means you accept the revised terms.
2. About Our Service
TAG Market is an e-commerce marketplace operated by Tag Market West Africa Limited, a company registered in Cote d'Ivoire (Ivory Coast), West Africa (referred to as "we", "us", or "our"). TAG Market sells premium Kenyan tea sourced from the Kericho highlands and Great Rift Valley regions of Kenya. Our catalog includes 50+ tea varieties curated directly from origin farms and producers.
Our platform allows you to browse products, create a cart, place orders for delivery across 50+ African countries, authenticate using email-based one-time passwords (OTP) or magic links, and view your order history through a customer dashboard.
3. Eligibility and Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use our Services. By placing an order, you represent that you meet this requirement.
Creating an account is optional to browse and build a cart, but you must authenticate (via email OTP or magic link) to view saved orders in your dashboard. You are responsible for safeguarding access to the email account linked to your TAG Market profile. Any activity performed through your authenticated email is your responsibility.
You agree to provide accurate, current, and complete information during checkout, authentication, and any other interaction with our Services. False or misleading information may result in order cancellation or account suspension.
4. Cart Tokens and Device Storage
To maintain your shopping session across pages, we generate a random, unique cart token (UUID) and store it in your browser's localStorage under the key 'cart_token'. This token is sent in the HTTP header 'X-Cart-Token' with every cart-related API request so our backend can associate your cart items with your browsing session. Clearing your browser storage or switching devices will reset your cart.
We also store locale preferences (selected country, selected language, and a confirmation flag) persistently in localStorage under the key 'user_locale' via the zustand state library, so that your shipping region and language settings persist across visits. Your country and language selection are also sent with each API request via the HTTP headers 'X-Country' and 'X-Language'.
You consent to these storage practices by using our website. You can clear these values at any time through your browser settings.
5. Orders, Pricing, and Payment
All prices displayed on our site are shown in the local currency associated with your detected or selected country (examples: KES for Kenya, NGN for Nigeria, GHS for Ghana, ZAR for South Africa, XOF for Francophone West Africa, USD as fallback). Exchange rates are pulled live from Open Exchange Rates. Prices include product costs only. Delivery fees are calculated at the payment step based on your address.
We make reasonable efforts to keep pricing accurate. In the event of a typographical error or mispricing, we reserve the right to cancel any order at the incorrect price and notify you by email.
Payments are processed securely by Paystack, our licensed payment processor. We do not store, collect, or have access to your full card details. Card data is handled exclusively by Paystack under its PCI-DSS compliant environment. By submitting payment, you also agree to Paystack's applicable terms and privacy policy.
Each payment attempt is logged in our payment_transactions database table with the transaction reference, email, amounts in USD and local currency, currency code, status (initiated, success, failed, abandoned), and the raw Paystack webhook payload for reconciliation. Order confirmation via our checkout API does not guarantee acceptance. We reserve the right to refuse, cancel, or limit quantities of any order for reasons including stock unavailability, payment verification failure, suspected fraud, or violation of these terms.
6. Checkout Information You Provide
At checkout you will be asked to provide: your email address, recipient name, phone number, delivery address (with optional city), delivery method (delivery or pickup), and any optional order notes (gift messages, delivery instructions, and similar). Address autocomplete suggestions are powered by LocationIQ, with queries sent by default to Kenya (country code KE) and returned to you as display_name suggestions.
Phone numbers are validated using a phone number library to ensure they are possible for the selected country. You confirm that any phone number you provide belongs to you or the intended recipient, and that the recipient consents to receive delivery-related SMS or calls.
It is your responsibility to ensure the delivery address is correct. We cannot be held liable for failed or misdelivered shipments caused by incorrect or incomplete address information provided at checkout.
7. Shipping and Delivery
We offer two delivery methods per order: door-to-door delivery and pickup. Available methods and their fees depend on your destination country and region. Delivery timelines are estimates and may vary due to customs, weather, courier backlogs, or other factors outside our direct control.
Title to and risk of loss for products passes to you upon handoff to the delivery courier. If a delivery attempt fails because the recipient is unavailable or the address is inaccessible, redelivery charges may apply.
You are responsible for any import duties, customs fees, VAT, or other taxes levied by your destination country, in addition to the price and delivery fee shown at checkout.
8. Returns, Refunds, and Cancellations
You may cancel an order free of charge at any time before it is dispatched for delivery. Contact us promptly with your order number to request cancellation.
If products arrive damaged, defective, or materially different from what was ordered, you may request a return or replacement within 7 calendar days of delivery. Products must be unopened, in their original packaging, and accompanied by proof of purchase. Perishable or personalized items may not be eligible for return unless damaged on arrival.
Refunds are processed to the original payment method and typically reflect within 5 to 10 business days depending on Paystack and your card issuer. Original delivery fees are non-refundable unless the return is due to our error (wrong item sent, defective goods).
We reserve the right to reject returns that appear fraudulent, abusive, or outside our stated return window.
9. Product Information and Availability
Product images, descriptions, tasting notes, and origin information are provided in good faith. Slight variations in packaging appearance or batch characteristics are normal for agricultural products and do not constitute a defect.
All products are subject to availability. We may discontinue or substitute products at any time without notice. 'Featured' badges and product sorting on our homepage may reflect editorial, seasonal, or promotional criteria determined by us.
Product images and assets are stored in Cloudflare R2 object storage and served via Cloudflare's global CDN. Category hero images are served locally from our frontend public folder.
Tea is a food product. You are responsible for reading ingredient and allergy information provided on product packaging before consumption. If you have food allergies or sensitivities, contact us before ordering to confirm suitability.
10. Acceptable Use and Prohibited Conduct
You agree not to: (a) use our Services for any unlawful purpose; (b) place orders with the intent to commit fraud, chargeback abuse, or resell commercially without our written authorization; (c) interfere with, disrupt, or attempt to gain unauthorized access to our systems, APIs, or user accounts; (d) scrape, crawl, or systematically extract product data or pricing from our website; (e) impersonate any person or entity or misrepresent your affiliation; (f) submit false, defamatory, or harassing content through reviews, messages, or order notes.
Any attempted or suspected violation of this section may result in immediate order cancellation, account suspension, and reporting to the appropriate authorities.
11. Intellectual Property Rights
All content on TAG Market, including our logo, brand name 'TAG Market', 'Kericho Gold' branding used on our site, product photography, copy, descriptions, UI design, typography, and custom graphics, is owned by or licensed to Tag Market West Africa Limited and is protected by copyright, trademark, and other intellectual property laws of Cote d'Ivoire and international treaties.
You may not reproduce, distribute, modify, republish, sell, resell, or create derivative works from any of our content or branding without our prior written consent. Limited, personal, non-commercial use of the website (examples: saving a product link, sharing it on social media) is permitted.
The names of featured tea farms, regions, and cooperatives referenced on our site are used with acknowledgment and remain the property of their respective owners.
12. Authentication Sessions
We offer passwordless authentication via two methods: one-time passcodes (OTP) sent to your email, and single-use 'magic links' sent to your email. Both methods authenticate the same underlying user profile identified by your email address. OTP codes are stored hashed in our otps database table with an attempt counter and expiry time. Magic link tokens are stored in our magic_links table and marked 'used' after one successful verification.
Successful authentication issues two JWT tokens signed with HS256: a short-lived access token (15 minutes) containing your user_id, email, and a session_id claim; and a longer-lived refresh token (7 days) stored in Redis and mapped to your session. Logging out deletes the refresh token from Redis, clears your local session state in React Query, removes all cached queries, and redirects you to the auth page.
Every authentication event (OTP request, OTP verify, magic link request, magic link verify, logout, refresh) is written to our auth_logs table with your email, event name, method, IP address, user agent string, success flag, and a JSONB metadata field. We use these logs for security audits, abuse detection, and customer support.
It is your responsibility to sign out of shared or public devices. We are not liable for unauthorized access resulting from your failure to secure access to your email account or sign out.
13. Taxes and Compliance
Prices may include or exclude applicable Kenyan VAT, Ivorian VAT, and other sales taxes depending on your shipping destination. Any taxes collected by us at checkout are remitted to the appropriate revenue authority as required by law.
You are solely responsible for determining whether your purchase complies with the import laws, food safety regulations, and agricultural import restrictions of your country. We are not responsible for packages seized or rejected by customs.
14. Disclaimers of Warranties
Our Services and all products are provided on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that: (a) the website will be uninterrupted or error-free; (b) defects will be corrected; (c) the platform or its servers are free of viruses or other harmful components; (d) search results or product availability will be accurate, complete, or reliable.
Content on our website regarding health benefits of tea is for general informational purposes only and is not medical advice. Consult a qualified healthcare provider before using tea or any herbal product for therapeutic purposes, especially if pregnant, nursing, on medication, or have pre-existing conditions.
15. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Tag Market West Africa Limited, its directors, employees, partners, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising out of your access to, use of, or inability to use our Services or products.
Our total aggregate liability to you for any claim arising out of or relating to these terms or the Services, whether in contract, tort, or otherwise, is limited to the total amount you actually paid to us for the specific order(s) giving rise to the claim during the 12 months preceding the event.
Nothing in these terms excludes or limits any liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation.
16. Indemnification
You agree to defend, indemnify, and hold harmless Tag Market West Africa Limited and its officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, investigations, fees, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these terms; (b) your violation of any law, regulation, or third-party right; (c) any order you place, product received, or interaction with a courier; (d) any content or information you submit through our platform.
17. Termination
We reserve the right, in our sole discretion, to suspend or terminate your access to all or part of our Services, without notice and without liability, for conduct that we believe violates these terms, is harmful to other users, us, or third parties, or is otherwise unlawful.
Sections of these terms that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) shall survive.
18. Governing Law and Dispute Resolution
These terms are governed by and construed in accordance with the laws of Cote d'Ivoire (Ivory Coast), without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these terms or your use of our Services shall first be submitted to amicable negotiation between the parties for a period of 30 calendar days from the date one party notifies the other in writing of the dispute.
If the dispute is not resolved amicably within those 30 days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Abidjan, Cote d'Ivoire, unless mandatory consumer protection law in your country of residence requires otherwise.
19. International Users
Our Services are controlled and operated from infrastructure hosted by Railway in the United States (US region) and fronted by Cloudflare's global content delivery network and security edge, also operating from US-based infrastructure. We make no representation that our Services are appropriate or available for use in every jurisdiction. Users who access our site from outside Cote d'Ivoire do so on their own initiative and are responsible for compliance with applicable local laws.
We support multiple languages (English, French, Portuguese, Arabic, Spanish) for user convenience. Product catalog translations are stored in our translation database table and applied at request time. The English version of these terms and our privacy policy is the authoritative version. In the event of a conflict, the English text prevails.
20. Monitoring, Logging, and Observability
Every HTTP request to our backend API is logged for monitoring, debugging, capacity planning, and security purposes. Logs are structured JSON events forwarded to Axiom (our observability and log analytics provider). Each log entry contains: a generated request UUID returned to you in the 'X-Request-ID' response header, HTTP method, request path, HTTP status code, request duration in milliseconds, the requesting IP address as seen by our backend, and the request User-Agent header.
We also maintain Redis-based rate limiting and session state for authenticated requests, and we cache pricing, currency conversion, and product search data in Redis to keep the site responsive.
These operational logs and metrics are not used for advertising or third-party marketing. They are retained for a finite window in Axiom and then purged according to our retention schedule.
